B. Keith Gibson’s practice focuses on the defense of products liability actions, mass tort matters, class actions and other complex litigation. Mr. Gibson has been involved in defending major U.S. and foreign corporations in actions brought in federal and state courts throughout the United States, at both the trial court and appellate levels. The actions in which he has been involved cover a wide variety of products, including high-performance fibers, electrical equipment, chemical products, construction equipment, and medical devices. These actions have involved novel legal theories, including the Alien Tort Statute, the False Claims Act, and the Foreign Sovereign Immunity Act, as well as issues of false and deceptive advertising, consumer fraud, and component part manufacturer liability. Mr. Gibson has defended companies in mass tort actions relating to the Holocaust, slavery reparations, the South African apartheid, and the 9/11 terrorist attacks at the World Trade Center.
Mr. Gibson has also counseled companies in managing crises and avoiding potential litigation. Additionally, he has advised companies on product liability issues of entities they have targeted for purchase or acquisition. Mr. Gibson has written numerous publications on various product liability and other complex litigation issues, including punitive damages, designer liability, expert evidence, and the Alien Tort Statute, among others.
Mr. Gibson has represented individuals pro bono before the New York Supreme Court, Appellate Division and in a federal jury trial in the Eastern District of New York. He has also assisted in the drafting of amicus curiae briefs to the United States Supreme Court relating to constitutional issues surrounding punitive damage awards.
Keith Gibson is a member of the Products Liability section of the American Bar Association and the City Bar of New York. Prior to joining the firm, he spent twelve years at Weil, Gotshal & Manges LLP as a member of the firm’s Product Liability and Mass Tort practice group.
