Biography
Daniel S. "Dan" Weinstock, medical malpractice attorney serving Philadelphia
Daniel S. "Dan" Weinstock is an attorney based in Philadelphia, PENNSYLVANIA. The practice focuses on Medical Malpractice, Personal Injury, and Product Liability. Daniel has over 32 years of legal experience. Daniel works from Philadelphia, Pennsylvania and takes on medical malpractice matters across the region.
Daniel S. Weinstock focuses his practice on representing families of children with cerebral palsy and brain or spinal cord injuries caused by medical negligence. He has won multimillion dollar verdicts and settlements against obstetricians, pediatricians, and other healthcare providers in 15 different states, and he regularly tries catastrophic medical negligence cases in courtrooms across the country on a pro hac vice basis.
In 2012, Dan obtained a record-breaking $78.5 million verdict on behalf of a family whose child has cerebral palsy secondary to a brain injury she suffered due to a hypoxic ischemic event just before birth. This is the largest medical negligence verdict awarded by any Pennsylvania jury since the passage of the MCARE Act in 2002 (which limited medical negligence claims in Pennsylvania), and is the second largest medical negligence verdict in Pennsylvania history. The case was settled while an appeal was pending for a sum that is believed to represent the largest actual medical negligence recovery in Pennsylvania history.
In 2015, Dan secured a record-breaking pretrial settlement in a Central Pennsylvania case in the amount of $20 million. This recovery, made on behalf of a family whose child suffers from cerebral palsy as a result of elevated bilirubin and kernicterus experienced during the neonatal period, is believed to be the largest such medical negligence recovery in Pennsylvania history.
In addition to these two cases, Dan has secured dozens of recoveries in the range of millions and tens of millions of dollars, both by verdict and settlement, in several states throughout the country.
As a Philadelphia Birth Injury Lawyer, Dan has been named a Pennsylvania Super Lawyer every year since 2005, and is listed among the Top 100 Lawyers in both Philadelphia and Pennsylvania. He also teaches trial advocacy to students at the Widener University School of Law and serves as an adjunct professor of trial advocacy at the Temple University Beasley School of Law, where he teaches trial strategy and technique to practicing attorneys seeking an LL.M in Trial Advocacy.
Dan holds a plenary license to practice law in the state and federal courts of Pennsylvania and New Jersey, North Carolina, the U.S. Court of Appeals for the Third Circuit, and the U.S. Supreme Court. He also has handled cases in Arizona, Arkansas, California, Delaware, Florida, Georgia, Illinois, Maryland, Massachusetts, Minnesota, Missouri, New York, Ohio, Oklahoma, Tennessee, Texas, and West Virginia when admitted on a pro hac vice basis.
