Dessislava Nintcheva Day has practiced law in California for over 19 years, during which time she has represented employers in a wide spectrum of employment law disputes, including wrongful termination, discrimination, harassment, retaliation, wage and hour, whistleblower, trade secret violations, and representative actions. She counsels employers on employee discipline, leaves of absence, accommodations, compensation, and employment agreements. Ms. Day drafts and updates employment policies and handbooks, conducts workplace investigations and audits, and assists with HR compliance issues. She has represented employers in all courts in the state of California, in arbitration proceedings, and in administrative proceedings before state and federal agencies, including the U.S. Equal Employment Opportunity Commission, California Department of Fair Employment and Housing, and the California Labor Commissioner.

Ms. Day also has extensive experience defending complex business disputes, product liability, warranty, and elder abuse cases, and has represented businesses of all sizes and in most industry sectors. Some of her representative matters include the successful defense of employment cases against one of the nation’s largest healthcare insurers and large retail establishments; commercial disputes on behalf of global energy and petrochemical companies; product defect cases against automobile manufacturers; and a public university in administrative mandamus proceedings.

In addition to her law practice, Ms. Day is also actively involved in several professional organizations. She is the Vice Chair of the DRI Employment Law Committee and has served on the DRI Employment Law Steering Committee for over a decade. Ms. Day has assisted with planning the DRI Annual Employment Law Seminar, which is one of the preeminent CLE events for management side labor and employment practitioners, in-house counsel, and EPLI representatives nationwide. She also had the privilege of chairing the DRI Employment Law Seminar in Austin, Texas in 2016, and is a regular speaker at DRI Employment Law events. She is a prior Co-Chair of the Litigation Section of the San Diego County Bar Association, and a member of the Lawyers Club of San Diego, ABTL, and the American Inns of Court, Louis M. Welsh Chapter No. 9.

Ms. Day graduated with her Juris Doctorate from the University of North Carolina, School of Law in 1999, where she served on the Editorial Board of the Journal of International Law and Commercial Transactions, and was a Member of the UNC Law Moot Court/Trial Law Academy Team. She received a Bachelor of Arts degree in Political Science and Management from Guilford College in 1995 and graduated with honors.
