Jason Weinstein joined Weitz & Luxenberg’s skilled and talented Appellate Unit in 2017. He is providing considerable assistance to our Mesothelioma and Asbestos litigation team and turning his talents to our Defective Drugs and Devices litigation unit cases as well as our Personal Injury and Malpractice litigation unit.

Our firm’s Appellate Unit is unlike any other Weitz & Luxenberg litigation division. The attorneys in this unit do not work for or within one specific litigation unit. Instead, Mr. Weinstein and his colleagues in the Appellate Unit perform essential appeals expertise across our litigation-specific units.

When Weitz & Luxenberg secures a victory in court against an asbestos manufacturing company, that asbestos company may decide to appeal the decision. Our firm’s appellate attorneys, including Mr. Weinstein, work to ensure that these decisions are upheld.

Already, Mr. Weinstein has proven he is up to the task of navigating the legal intricacies involved with appellate casework, crafting legal documents essential to our litigations. We feel privileged Mr. Weinstein decided to join our division of Appellate attorneys at this juncture in his career.

Notably, Mr. Weinstein has written and argued appeals across most of New York State before the New York Court of Appeals, as well as the Appellate Division, First Department, Second Department, and Third Department.

Prior to joining Weitz & Luxenberg, Mr. Weinstein worked for the New York Prosecutors Training Institute for several years. In addition to writing and arguing direct appeals to the New York Court of Appeals and the Appellate Division, Mr. Weinstein supported prosecutors across the state engaged in trial and pretrial practice by performing extensive, time-sensitive legal research.

From 2010 to 2013, Mr. Weinstein served as an associate at The Hoffinger Firm, PLLC, formerly Hoffinger Stern & Ross, LLP, in New York City. One of his primary responsibilities was working as part of a team representing clients in federal and state court in complex criminal and civil litigation matters. He also spent considerable time researching and drafting legal documents.

From August 2006 until May 2010, Mr. Weinstein worked for the Nassau County District Attorney’s Office in Mineola, New York, where he was charged with representing the District Attorney’s office in postconviction and other appellate litigation.

Over his years with the District Attorney’s office, his primary responsibilities included writing and arguing direct appeals to the appellate division, postconviction collateral motions to set aside judgment or sentence, and federal habeas corpus petitions. He also prosecuted misdemeanor cases and conducted plea negotiations, as well as a range of litigation, from pretrial motion practice and suppression hearings to trials.

Mr. Weinstein earned his juris doctorate in 2006 from the Benjamin N. Cardozo School of Law in New York, where he served as a member of the initial group of Public Service Scholars, and was a member of the Moot Court Honor Society. In addition, Mr. Weinstein worked as a legal writing teaching assistant and served as a research assistant for then-Dean David Rudenstine.

Mr. Weinstein is also noted for graduating cum laude, in the top 10% of his class at the Cardozo School of Law and was named a member of the Order of the Coif. In addition, before graduating, he was a judicial intern for a District Court judge in the Eastern District of New York and a legal intern with the United States Attorney’s Office in the Southern District of New York.

Mr. Weinstein received his A.B., cum laude generali, in English literature in 1995 from Vassar College in Poughkeepsie, New York.

Mr. Weinstein is admitted to practice law in New York and the following federal courts: Second Circuit Court of Appeals, Ninth Circuit Court of Appeals, and the U.S. District Courts of the Southern and Eastern Districts of New York.

Outside of his work at Weitz & Luxenberg, Mr. Weinstein happily devotes time to his family.
