Trial Lawyer and Competition Advocate

Brendan P. Glackin chairs the firm’s antitrust practice group. He has practiced antitrust law for over two decades and has tried more than 20 civil and criminal cases. He served as trial counsel in the liquid crystal displays (LCDs) price-fixing litigation ($470 million in settlements); and the Norvir antitrust litigation. He also served as lead trial counsel for the firm in the titanium dioxide price-fixing class action ($163.5 million in settlements), which settled days before jury selection. Mr. Glackin also recently served as lead trial counsel by a coalition of 39 state Attorneys General prosecuting Google for anticompetitive dominance of Android app distribution. He worked in that matter as a Special Assistant Attorney General for the State of Utah.

Mr. Glackin currently serves as lead counsel in a proposed federal class action challenging the 2020 merger of T-Mobile and Sprint. The merger reduced the overall number of mobile carriers in the U.S. from four to three and thereby fundamentally altered and reduced competition between the three remaining behemoths: the new T-Mobile, AT&T, and Verizon. The lawsuit seeks damages and the restoration of competition in one of the world’s largest and most concentrated markets. He also leads the firm’s representation of insurers against U.S. Anesthesia Partners, a private-equity-backed venture that has consolidated hospital-based anesthesia in Texas.

Mr. Glackin has led or made major contributions in past cases totaling over a billion dollars in recovery for consumers, workers and small businesses. In addition to his trial work, Mr. Glackin led the firm’s representation of consumers in the lithium ion batteries price-fixing case ($115 million recovered) and the generic enoxaparin monopolization case ($120 million recovered). With others he received a 2016 “California Lawyer Attorney of the Year” (CLAY) award for his work in a case against drug makers for blocking access to affordable generics versions of the blockbuster drug Cipro ($399 million in settlements).

He also earned, with others at the firm, a well-deserved 2019 “Outstanding Antitrust Litigation Achievement in Private Law Practice” award from the American Antitrust Institute (AAI) for his work on Seaman v. Duke, a class action case around wage suppression, challenging a secret no-hire agreement between the Duke and UNC Medical School Deans which led to a final settlement of $54.5 million in 2019. AAI similarly honored Mr. Glackin 2017 and 2020 for his work in other cases. Mr. Glackin also successfully argued class certification in the In re High Tech Employees Antitrust Litigation ($435 million recovered).

Mr. Glackin regularly serves as faculty for National Institute for Trial Advocacy (NITA), the pre-eminent trial advocacy training program in the United States. He annually teaches negotiation skills for the Practising Law Institute (PLI). He serves as a Vice-Chair of the ABA Antitrust Section’s U.S. Policy & Comments Committee, and helped re-establish the Executive Committee of the Antitrust Section of the Bar Association of San Francisco. He has been a regular panelist at the ABA Antitrust Section Spring Meeting, the pre-eminent gathering of antitrust lawyers in the world, as well as AAI’s annual private enforcement conference. He routinely speaks, publishes, and teaches on antitrust issues.

Mr. Glackin has been recognized as one of Lawdragon’s 500 Leading Lawyers in America consistently from 2019 to 2024, and The Daily Journal named him a Top Antitrust Lawyer in California in 2020. He has also been listed as a “Super Lawyer for Northern California” from 2013 to 2024.
